Glossary of Terms

de jure: by right, of right, by law;
describes practices that are lawfully recognized, regardless of whether the practice exists in reality
de facto: in fact, in deed, actually;
describes practices that exist in reality, even though they are not lawfully sanctioned

lawful: rightful; refers to the substance of law and emphasizes the ethical content of law;
based on internal authority, self-responsibility, justice, reason, broad principles (maxims of law), and common sense;
common law, natural law, ecclesiastical law
legal: refers to the form of law and emphasizes the technical aspects of law;
based on external authority, fixed rules and regulations;
statutory law, maritime law, commercial law

lawful hierarchy of power in a de jure constitutional republic: a hierarchy where at each level, the creator governs the creation, and never the other way around;
from top to bottom:
1. Creator/God
2. We the People
3. common law
4. constitution
5. government
6. public servants
7. statutory law
8. corporations
governments are a creation of, and therefore exist in service to, We the People, with no lawful authority to rule over living men and women

jurisdiction: the power, right, or authority to interpret and apply the law;
the limits or territory within which authority may be exercised;
to speak or say the law (“juris” = of law, “diction” = to speak);
the words we speak impact our placement and authority within bodies of law;

maxim of law: an established principle or proposition; a principle of law universally admitted; a broad & comprehensive principle based on justice, reason and common sense; a brief statement of self-evident truth
